What Honolulu County Probate Records Cover

HRS Chapter 560, the Hawaii Uniform Probate Code, is the main statutory source for Honolulu County probate. It governs estate administration, intestacy, wills, personal representatives, creditor procedures, guardianship and conservatorship, and related fiduciary duties.

  • Wills and codicils.
  • Estate petitions, including informal and formal probate.
  • Personal representative appointments and letters.
  • Guardianship and conservatorship matters for adults and minors.
  • Trust matters and trustee filings.
  • Inventories, appraisals, and accountings.
  • Creditor claims and notices.
  • Distribution orders and final accountings.
  • Contested wills and probate disputes.
  • Ancillary probate when out-of-state property is involved.

Some small estates may move through nonprobate transfer processes under Chapter 560 rather than full probate. The Estate & Probate Branch and First Circuit Legal Documents Branch can confirm which path fits a given Honolulu County probate matter.

Honolulu County Probate Case Number Formats

Honolulu County probate case numbers follow the same 12-character JIMS/JEFS rule as other Circuit cases. Legacy probate codes such as EQ, G, P, SE, SG, TR, T, C, and CG all convert into the standard 12-character format with the leading "1" for the First Circuit. Modern hyphenated formats are used for newer filings.

  • Estate: P-style legacy codes convert to the 12-character JIMS form, with the leading "1" marking the First Circuit.
  • Guardianship: G or SG legacy codes follow the same conversion rule.
  • Trust: TR or T legacy codes also convert with the leading "1."
  • Modern probate: uses the hyphenated format with court indicator, year, and sequence; leading zeroes in the sequence can be omitted.

How Honolulu County Probate Works

  1. Determine whether the estate qualifies for full probate or for a small-estate or nonprobate transfer under Chapter 560.
  2. File the petition or application with the First Circuit Estate & Probate Branch.
  3. Provide the death certificate, will if any, heir or devisee information, proposed personal representative information, and required notices.
  4. The court issues an order and letters if approved.
  5. The personal representative gives creditor and heir notices, inventories assets, manages the estate, pays claims and taxes, and distributes property.
  6. The court may require accountings, hearings, and final closing documents.
  7. Will contests, real estate disputes, missing heirs, creditor disputes, tax issues, or multi-state assets can extend the timeline.

Probate timelines vary widely. An uncontested simple estate may close in months. A contested probate or one with real estate, business interests, or out-of-state assets can take years.

Guardianships and Conservatorships

Honolulu County guardianship cases cover decision-making for minors and incapacitated adults. Conservatorship cases cover the management of an adult's finances. Both run through the Estate & Probate Branch. Filings often include medical and financial information, so HCRR Rule 9 protections apply and parts of the case may be sealed.

Executor / Personal Representative
